Dick Smith’s food company suffered a major blow after the court ruled that the name of its flagship OzEmite spread must be replaced. Niranjan Hiranandani files suit in HC against daughter for alleged trademark infringement

Niranjan Hiranandani, who is a leading real estate businessman has filed a case in Bombay High Court against his daughter Priya Hiranandani Vandrevala, seeking to intimidate her from using the name ‘Hiranandani’ in her business. The suit has also sought Rs 50 crore damages for alleged infringement of copyright and trademark by ‘Hiranandani Living Pvt Ltd’ promoted by defendant Priya. PepsiCo Inc move to HC against movie ‘Youngistaan’ on trademark infringement

Alleging that the name of the film “Youngistaan” has violated its registered trademark and campaign by that name some years ago, global soft drink major PepsiCo Inc has moved the Delhi High Court against releasing the film and has sought a permanent injunction against the release of the movie. King Abandons the Battle to Trademark “Candy” in U.S.

Candy Crush Saga maker King has withdrawn its attempt to trademark the word “Candy” in the U.S. This decision follows after acquiring the rights to a “Candy Crusher” trademark filed by Harrier Software last year. “This does not affect our E.U. trademark for Candy and we continue to take all appropriate steps to protect our IP,” the company said in an emailed statement. MMA brand ‘Venum’ sued by Nike for alleged Trademark Infringement

Nike, the global sports apparel giant has filed a case against the owners of MMA brand ‘Venum’ for allegedly infringing on their trademark.  A copy of the complaint, which was obtained by Sherdog.com alleges false designation of origin, unfair competition and seeks cancellation of trademarks by Nike.  The case was filed on January 8, 2014, in Oregon District Court. Disney Sued over “Lotso” the Bear Character in ‘Toy Story 3’

Four years after the release of the movie ‘Toy Story 3’, Disney Enterprises, who produced the film, was sued for alleged trademark and patent infringement at the Texas Federal Court by the owner, Diece-Lisa Industries who objects to the “Lots-O’-Huggin'” a character in the movie, which is a stuffed bear.  This character — aka “Lotso” — has psychological problems as a result of being abandoned by his owner. ‘Marine’ trademark infringement case favours Pidilite

The Mumbai High Court has issued a favourable order to Pidilite Industries by preventing another company from using the word ‘Marine’ on its products.  Pidilite Industries is one of the leading companies of adhesives and makers of well-known brands ‘Fevicol’ and ‘Fevicol Marine’.  Pidilite Industries had earlier filed a case in the court against Jubilant Agri & Consumer Products (JACP) for using its name ‘Marine’ for a product called ‘Jivanjor Marine Plus’.  Pidilite also claim that the word ‘Marine’ is registered with them and the usage of the term is a potential infringement on its trademark. ‘Shahs Of Sunset’ Star Asa Rahmati wins Trademark Infringement Lawsuit

Asa Rahmati who starred in the American reality television series ‘Shahs of Sunset’ has won a legal battle after her water bottle company was slapped with a trademark lawsuit in federal court.  Gastroceuticals, LLC filed a lawsuit against Rahmati’s company, Diamond Water, LLC, in October 2013, demanding a jury trial and also claimed that the federally registered trademark “Dymund” was owned by them in accordance with their water bottles and asked Rahmati’s competing company to cancel their all-too-similar trademark. Overstock.com Sues NoMoreRack.com alleged Infringement of its Trademark

A complaint was filed by the Salt Lake City–based e-tailer Overstock.com against its competing discount site NoMoreRack.com in the Utah Federal Court, saying the that the site was infringing on its trademarks by purchasing ads in Google with the word ‘Overstock’ in them.  Overstock.com also claim that the online ads prominently featuring the word overstock in a nearly identical font to its trademark.  The company says, “In these advertisements and others displayed on the Internet, Nomorerack intentionally and regularly capitalizes Overstock as though it was proper noun to foster additional confusion with the Overstock.com brand.” (さらに…)
