‘Shahs Of Sunset’ Star Asa Rahmati wins Trademark Infringement Lawsuit
Asa Rahmati who starred in the American reality television series ‘Shahs of Sunset’ has won a legal battle after her water bottle company was slapped with a trademark lawsuit in federal court. Gastroceuticals, LLC filed a lawsuit against Rahmati’s company, Diamond Water, LLC, in October 2013, demanding a jury trial and also claimed that the federally registered trademark “Dymund” was owned by them in accordance with their water bottles and asked Rahmati’s competing company to cancel their all-too-similar trademark.
According to reports, the federal court judge shot down the rivals and denied granting an injunction against Rahmati’s Diamond Water. According to the court documents, the judge claimed that the plaintiff’s arguments were weak, stating the bottles are immensely different and don’t look alike at all.
According to the documents the judge also noted that it is most unlikely that the consumers wouldn’t confuse the Bravolebrity’s special brand of diamond-infused alkaline bottled water with Gastroceuticals’ product due to Rahmati’s huge popularity.
Rahmati, 37, asserts that the trademarks for both Diamond Water and Asa’s Diamond Water is something that she she owns lawfully, and that consumers will not confuse them with “Dymund” — which isn’t even well-known or famous to the general public. The case is still pending in federal court.
