Vermont baker wins trademark infringement case


A baker based in Vermont who prepares products which are free of gluten has resolved its trademark infringement suit against an enterprise, which has a similar name.

A trademark infringement lawsuit was filed in October last year by ‘Against The Grain Gourmet Foods’ a bakery situated in Brattleboro, Vermont, against ‘Against All Grain’ in California, which is actually a blog wherein the author Danielle Walker posts gluten-free recipes and in fact he already has written a book named “Against All Grain.”

‘Against The Grain Gourmet Foods’ accused Danielle Walker of possible trademark infringement and demanded a cease-and-desist order against the blog. Brattleboro Reformer claim that Tom and Nancy Cain in Vermont had actually started their business in 2006 and had applied for a trademark for the same and got the mark sanctioned way back in 2008. They also claim that they have been using the name since then.

A representative of the company asserts that the blog will change its name to “Danielle Walker’s Against All Grain” and he also asserts that Walker will not go after a trademark for “Against All Grain.”
