SAIL accuse Re-Rollers of Misusing its Trademark

Steel Authority of India (SAIL) has reportedly filed about five FIRs against Re-Rollers for reportedly putting its logo on their product and has begun exchanging their bank guarantees, besides claiming crores of rupees in compensation for misusing its brand name. Over the past year, SAIL has been getting information that counterfeit steel products bearing its trademark have swamped the markets across the country. These products mainly consist of TMT rebars and structural items and these products not only breaches provisions of the Trademark Act, 1999 but also pose a risk to the public.

Vinod Kumar, who is SAIL’s commercial director told, “Following credible inputs, we formed crack teams which visited various locations and have filed about 4-5 FIRs so far for misusing the SAIL brand. Our company has also begun encashing bank guarantees of the company’s agent Raipur-based SKS Ispat. We caution errant re-rollers to refrain from producing spurious products bearing SAIL’s trademarks.”

Mr. Kumar also told that SAIL has also started legal action against those misusing its logo and has claimed financial compensation amounting to “hundreds of crores of rupees.” He also said that the central marketing organisation of SAIL has also filed FIRs against Raipur-based re-rollers, Pankaj Ispat and Alankar Alloys, and found them to be infringing trademark laws by illicitly producing TMT bars bearing SAIL trademarks. He said that the proprietors of these two companies have been put behind the bars and the Enforcement Directorate has confiscated assets valued Rs 7 crore from them last month. SAIL also filed an FIR against Hyderabad-based Ramky Infrastructures for utilizing counterfeit TMT bars with SAIL logo for the Rs 1625-crore Srinagar-Jammu highway expansion project.

When asked about the amount of financial loss SAIL had to incur due to the duplicate products, Kumar says that it will take to ascertain the actual losses incurred, while the initial estimate is few hundreds of crores of rupees.
