Quality Roofing Services sued for being involved in trademark infringement
A California-based roofing company filed a suit against one of its former employee for being involved in trademark infringement. The case was filed by Petersen-Dean Inc. on March 20, 2014, in the Houston Division of the U.S. Court for the Southern District of Texas against Jason Brinkmann, who started business as Brinkmann Quality Roofing Services Inc., mentioning trademark infringement.
As per the complaint Brinkmann’s father commenced a roofing company named Brinkmann Investments Inc. in the year 1971. However, Petersen-Dean bought Brinkmann Investments in 2007, and hired Brinkmann with an agreement declaring not to start a competing firm for five years after leaving the company.
Petersen-Dean, however, tells that Brinkmann resigned on March 29, 2013, and for a year after his resignation, he was doing preparing to start business under the Brinkmann name as a competitor, and was also involved in buying relevant domains. Petersen-Dean is accusing Brinkmann Quality Roofing on charges of trademark infringement, counterfeiting, domain name infringement, and unfair competition. Petersen-Dean is also trying for a judicial decision preventing the defendant from starting the rivalling business as well as reimbursable of all court costs incurred by him.
