Fluke extends a generous hand to SparkFun for loss suffered in the multimeter trademark dispute

A shipment of 2000 digital multimeters (DMMs) of SparkFun got into trouble with the US Customs and Border Protection after being found that it infringed into the trademark design of dark gray and yellow colour design of Fluke Corporation. In a blog post, SparkFun, an online retailer of electronics goods and which also offers DIY classes, wrote that US authorities say that it must destroy a recent shipment of 2000 multimeters (worth $30,000) for the reason that it resembled those sold by Fluke Corporation. Trademark infringement case filed against Einstein Bagels’ parent company

A trademark dilution lawsuit has been registered against the Einstein Noah Restaurant Group in the U.S. District Court in Denver by the Aurora-based Honey Smoked Fish Co. Einstein Noah Restaurant Group is based in Lakewood and is the owner and producer of the widely popular Einstein Bros. Bagels, Noah’s New York Bagel and Manhattan Bagel. The lawsuit claims that Einstein initially approached the Honey Smoked Fish Co. about potentially offering salmon branded under the Honey Smoked trademark at its restaurants. However, the lawsuit claims that despite the initial concern by Einstein, the company decided to instead “simply copy the brand without permission to benefit from the goodwill Honey Smoked Fish Company already created.” (さらに…)

Bronx entrepreneur sues the Brooklyn Nets claiming trademark infringement

An entrepreneur from Bronx has filed a trademark dilution case against Brooklyn Nets claiming that he owns the trademark rights to the team’s name. Dr. Francois De Cassagnol, 66, claims that he gained rights for trademarking the name for his commercial art business almost ten years ago while living in Louisiana. In the suit filed by him in the Brooklyn Federal Court in December, he claimed that he wanted at least $600 million as damages. The art seller also alleges in his complaint that he spoke with the team officials about the matter and that they had promised him that they would not use the name “Brooklyn Nets” upon moving to their new home by Atlantic Avenue two years ago. In a move that is expected to boost the local economies and business, the Japanese government has decided to allow regional chambers of commerce and nonprofit organizations to register trademarks for so-called B-class cuisine, commercial jingles and even colours. Most of the older Americans associate the Schlafly name with Phyllis Schlafly, the conservative commentator recognized for her campaign to defeat the Equal Rights Amendment in the 1970s, whereas the younger generation knows Schlafly as an up-coming brewery in St. Louis co-founded by Schlafly’s nephew. Pelosi Says ‘Redskins’ Should Not be Protected by Trademark Office

Nancy Pelosi, the House Minority Leader said on Thursday that the word “redskins” should be removed from the status of a trademark.

While speaking in an event hosted by the National Congress of American Indians, Pelosi said that the U.S. Patent and Trademark office should reject names which are considered offensive as they have done in the past.
