What is a trademark?


A trademark is a recognizable symbol, design, expression, or a combination of these, which distinguishes products or services of a particular source from those of others. The owner of a trademark can be an individual, organization doing business, or any legal entity. A trademark must be registered with a government patent office to assure its exclusive use by its owner. A trademark may be located on a package, a label, a voucher or on the product itself. So a trademark, serves as a badge of origin of the product. A trademark typically represents the name of the maker, not the product.

In short, a trademark can be typically defined as a name, word, phrase, logo, symbol, design, image, or a combination of these elements adopted and used by a manufacturer or merchant to distinguish their product or products from the ones manufactured or sold by others.
