In which case will my Trademark registration be cancelled before tenure?
If the registered trademark has not been in use for over the past 3 years, i.e., three years from the date of registration of the trademark or three years from any given date, anyone can appeal for a cancellation trial against the registration claiming it’s non-use.
In such case of appeal for cancellation of the trademark, the registrant of the trademark will then have to prove that the mark is in use, or that there is a solid reason justifying it’s non-use for the period.
A trademark will also be cancelled if someone successfully proves that the trademark infringes on the trademark right of that person. However, conducting a proper Trademark Comprehensive Study greatly reduces this possibility.
