Are there any ways through which I can revoke a registered trademark?
Yes, there are three ways to revoke a registered trademark. They are:
(i) Opposition
Any person can file an opposition against the trademark registration within two months of the publication date of the registration.
(ii) Invalidation Trial
An invalidation trial can be demanded at any time by an interested party in case the opposition for registration was not successful or the time period for filing an opposition has passed.
(iii) Cancellation Trial
Any person can request cancellation of the registration if a registered trademark has not been used within the past three years after registration. This method is efficient at times when the registered trademark is cited as a prior registration against your pending application.
