How is a well-known trademark protected in Japan?
In Japan, a third party cannot register a trademark in relation to any goods/services if the intended trademark is similar to or identical to a trademark already well-known in Japan.
The Japanese Trademark Law itself protects the well-known trademark in Japan against such unauthorized use. However, as mentioned above, an injunction cannot be obtained by the owner of the trademark under the Trademark Law of Japan to prevent any unauthorized use of identical or similar mark by a third party unless the well-known mark is registered with the Japanese Patent Office.
