Can I enjoy the priority benefit when applying for a trademark in Japan if I already have obtained a trademark right in my home country?
It is possible to obtain such priority benefits if your home country is a party to the Paris Convention, the TRIPS Agreement, or the Trademark Law Treaty. In such case you may file an application claiming priority based on the application filed in your country within six months of the filing date.
If the priority claim is accepted by the Japanese Patent Office, examination of the corresponding Japanese trademark application will be made based on the filing date of the application done at the home country.
